AGA attorneys take the field to support Make-A-Wish Foundation

Ansell Grimm & Aaron P.C. Community Association Practice Group attorneys Lysa Bergenfeld and Stacey Patterson teamed with Erika Berfumo from Certa Pro Painters, Valentine Valdman from Station Square, Ray Ambrosino and Brad Memoli from Garden State Securities, Caesar Mistretta from Hub International Insurance Brokers, and Bob Rogers and Dawn Ruggiero from First Service Residential at Community Association Institute’s 2nd Annual Olympics, at Thompson Park in Monroe. Proceeds from the July 20 event are donated to the Make-a-Wish Foundation which arranges experiences for children with life-threatening medical conditions.

Majority Rules or Rule by Super Majority? It Depends…

In the latest issue of Association Help Now, David Bryne, managing partner of Ansell Grimm & Aaron’s Community Association Practice Group addresses the tricky question of vote counting when it comes to issues affecting the declarations and bylaws of homeowner’s associations.

“In New Jersey, the general rule is the amendment percentage is set by the document that is sought to be amended, except in certain situations” Byrne explains in the article, “A condominium can be terminated if 80% of everyone votes to terminate. That’s a provision set by statue.”

Patterson participating on panel for Hudson Valley CAI

Stacey Patterson, Counsel in Ansell Grimm & Aaron’s Community Association Practice group, will be a panel speaker at the Hudson Valley Chapter of Community Associations Institute’s Managers Lunch on March 16 at Cosimo’s On Union, New Windsor, New York.

David Spector, Senior Vice President with Extell Management Services Inc., a company that manages the most highly-valued residential building in New York City — One57, will be the special guest speaker.

The lunch will be held from 11:30 a.m. to 1:30 p.m. with the first half hour reserved for networking.

at IREM Tri-State Conference & Expo in Atlantic City

The Institute of Real Estate Management, more commonly known as IREM, is an international organization of professional property managers who manage all different types of real estate. Association’s Receivership and Lease Still Valid After Sheriff’s Sale

In late 2012, our client, Vail Section Condominium, successfully moved to have an empty and abandoned unit placed into receivership. The condominium’s receiver, after having the abandoned unit repaired, made and executed a lease with a tenant. This tenancy (and the condominium’s enjoyment of rental receipts) continued on through 2015. During the course of this tenancy, the particular condominium unit’s lender completed its foreclosure. That lender ultimately purchased the unit at sheriff’s sale, in the fall of 2015. The tenant eventually became delinquent in the payment of rent resulting in the receiver’s eviction complaint. The court – even though the lender’s foreclosure was over, the lender had purchased the unit at sheriff’s sale and even after the sheriff’s deed associated with that sale was recorded by the lender – validated the receivership and the receivership’s lease. To that end, and months and months after the lender’s sheriff’s sale, the court found in favor of the receiver, entered a judgment for possession and ordered that the tenant be evicted. This decision – and condominium/receivership victory – reminds us that those timid and skeptical professionals and owners, who are frightened of the reach and power of lenders, are wrong to consistently shy away from asserting the rights and needs of condominiums and HOAs that continue to suffer from the scourge of abandoned and empty homes.

Stacey Patterson a featured speaker for CAI of Hudson Valley at roundtable

On January 21, 2016, Stacey Patterson was a featured speaker at the Community Associations Institute of Hudson Valley’s Round Table Seminar in New Windsor NY. Ms. Patterson, among other Hudson Valley community association industry experts, answered questions from property managers, board members and owners. Participants were able to obtain continuing education credits for their attendance.

Ms. Patterson serves as counsel with the firm in the Community Association Practice Group of Ansell Grimm & Aaron PC. Ms. Patterson represents numerous condominium, HOA and co-ops in the Hudson Valley, New York region. Ms. Patterson currently works out of the firm’s Woodland Park, NJ and White Plains, NY offices.

Byrne a featured speaker at Hudson Valley Roundtable

David J. Byrne, Esquire, Chair of the Ansell Grimm & Aaron Community Association Practice Group, will be among the industry experts available at the Community Associations Institute of Hudson Valley’s Round Table Seminar on Jan. 21. The roundtable, to be held at Homewood Suites at Newburgh-Stewart Airport, New Windsor NY, is an opportunity for community association managers and board members to get answers to any questions they may have regarding issues with their property. In addition to Byrne, Engineer Dave Chesky of the Falcon Group and CPA John Grady of Bogush & Grady will be among the experts available.

Participants in the roundtable can receive 2 CEU credits for taking part in the educational seminar, which runs from 5 to 7 p.m.

Much like commerce and entertainment, disputes with Co-Ops, Condominiums and Homeowner’s Associations are moving online. In the Sunday, November 8, 2015 edition of the New York Times, the growing role of social media in battles between residents and boards was examined. Seeking an expert opinion, the Times turned to Ansell Grimm & Aaron Community Association Practice group attorney Stacey R. Patterson to provide her experience with this issue.

New Princeton Address for Ansell Grimm & Aaron, PC

On January 1, 2015 Ansell Grimm & Aaron, PC (“AGA”) expanded by opening its first office in Princeton, New Jersey in the prestigious Carnegie Center.  AGA is now making a permanent home in Carnegie Center, with its move of its Princeton office to 214 Carnegie Center, Suite 112, Princeton, New Jersey.  The new location is open for business on Monday, November 23, 2015.

The office that housed AGA since January 1st was opened for the acquisition of a group of attorneys from an International law firm who represent condominium, cooperative, and homeowners’ associations.  Prominent homeowners’ association attorneys including Elysa Bergenfeld, Richard Linderman, Mark Wiechnik, Breanne DeRaps and Stacey Patterson led by Chair, David Byrne, joined the Princeton office to kick off 2015.  Since January, AGA has grown its Princeton office to service corporate, banking and individual clients.  New practice areas include real estate, creditors’ rights, bankruptcy, copyright, trademark and general litigation with the addition of attorney Pam Mulligan.  In addition, Mercer, Burlington and Middlesex County clients benefit from AGA’s convenient Carnegie Center location as they can meet with AGA attorneys from any of our five offices in Princeton. On July 13, 2015 Ansell Grimm, & Aaron, PC teamed up with HUB International, along with Rezkom Enterprises, Wilkin & Guttenplan, PC and Professional Restoration for a night with the Jets at the Jets Training Facility in Florham Park, New Jersey.

Our attendees were able to do drills on the Jets training field, as it was a gorgeous night, enjoy appetizers, dinner, refreshments and cocktails, and meet, talk to and toss the ball with one of the New York Jets’ premiere players, D’Brickashaw Ferguson. What a great night! Thanks to HUB, our co-sponsors, the New York Jets and especially all of our attendees!
