AGA Attorney Richard B. Linderman responds to HOA Questions

AGA Community Association Practice Group Partner, Richard B. Linderman recently responded to a question about when boards can require a 100% member vote to amend or repeal a covenant from a Homeowner’s Association Board Member or Manager which was featured in the “National HOA Questions and Answers” Column of Pennsylvania Association Help Now Newspaper.

Mr. Linderman noted that generally, in New Jersey and Pennsylvania, the declaration of covenant require either a two-thirds or 80% vote to amend.  Mr. Linderman noted that, from an operational standpoint, a 100% vote requirement would be impractical as it would give any member absolute veto power.

Mr. Linderman has successfully represented community associations in numerous litigations, including the defense of executive boards, complex construction suits, and statutory compliance related matters. Peers recognize quality work of AGA Attorneys

Four AGA lawyers have been named to the 2016 New Jersey Super Lawyers list and two AGA lawyers have been named to the 2016 New Jersey Rising Stars List.*

The AGA 2016 Super Lawyers are:

  • Allison Ansell Ryan, a partner with the firm and Chair of the AGA Family Law Department, has been named as a Family Law Super Lawyer for the past decade.

Patterson participating on panel for Hudson Valley CAI

AGA named 2016 Clara Barton Corporate Humanitarian of the Year

Ocean, New Jersey – The Jersey Coast Chapter of the American Red Cross has selected Ansell Grimm & Aaron, PC (“AGA”) to receive the prestigious 2016 Clara Barton Corporate Humanitarian of the Year Award. Feldman to be featured speaker at BCBA Seminar, Legal Issues Affecting Your Military Client

Jay Feldman, an attorney with Ansell, Grimm & Aaron and a member of the firm’s Litigation and Bankruptcy departments will discuss Debtor-Creditor issues and the Servicemembers Civil Relief Act at a seminar given by the Burlington County Bar Association’s Military Law Committee. Jay will be presenting with the Honorable Mark P. Tarantino, a Superior Court Judge with the Burlington County Vicinage. The seminar will take place on February 24, 2016 at the Burlington County Office Building in Mt. Holly, New Jersey at 4:30 pm.

In addition to his knowledge of legal issues that affect the military, Mr. Feldman devotes his practice to the areas of complex commercial litigation, lender liability litigation, contested foreclosure litigation, and bankruptcy litigation. This program has been approved by the Board on Continuing Legal Education of the Supreme Court of New Jersey for 2.4 hours of total CLE credit. “How To” Seminar on Foreclosure of Condominium, HOA Liens to Feature David J. Byrne

On February 9, 2016, David J. Byrne, Chair of Ansell Grimm & Aaron PC’s Community Association Practice Group will participate in a program designed to help attorneys properly foreclose on condominium and HOA liens. The program will be presented by The New Jersey State Bar Association’s CLE Lunchtime Webinar Program. Participants will learn about current law and procedures affecting the foreclosure of HOA and condominium liens. Mr. Byrne will present along with Kathryn Gilbertson Shabel, Esquire who currently serves as the Assistant Chief of the State of New Jersey Office of Foreclosure.

Mr. Byrne has represented condominiums and HOAs for more than 20 years, and has deep and vast experience in all aspects of lien foreclosures. Mr. Byrne and Ms. Shabel will instruct participants how to successfully foreclose on a HOA and/or condominium lien. They will also discuss some of more challenging aspects of such foreclosures, including abandoned units and receiverships, ‘surplus funds’, the recovery of the client’s attorneys’ fees and the relevance of the homes’, and/or unit’s, mortgage.

Association’s Receivership and Lease Still Valid After Sheriff’s Sale

In late 2012, our client, Vail Section Condominium, successfully moved to have an empty and abandoned unit placed into receivership. The condominium’s receiver, after having the abandoned unit repaired, made and executed a lease with a tenant. This tenancy (and the condominium’s enjoyment of rental receipts) continued on through 2015. During the course of this tenancy, the particular condominium unit’s lender completed its foreclosure. That lender ultimately purchased the unit at sheriff’s sale, in the fall of 2015. The tenant eventually became delinquent in the payment of rent resulting in the receiver’s eviction complaint. The court – even though the lender’s foreclosure was over, the lender had purchased the unit at sheriff’s sale and even after the sheriff’s deed associated with that sale was recorded by the lender – validated the receivership and the receivership’s lease. To that end, and months and months after the lender’s sheriff’s sale, the court found in favor of the receiver, entered a judgment for possession and ordered that the tenant be evicted. This decision – and condominium/receivership victory – reminds us that those timid and skeptical professionals and owners, who are frightened of the reach and power of lenders, are wrong to consistently shy away from asserting the rights and needs of condominiums and HOAs that continue to suffer from the scourge of abandoned and empty homes.

Stacey Patterson a featured speaker for CAI of Hudson Valley at roundtable

On January 21, 2016, Stacey Patterson was a featured speaker at the Community Associations Institute of Hudson Valley’s Round Table Seminar in New Windsor NY. Ms. Patterson, among other Hudson Valley community association industry experts, answered questions from property managers, board members and owners. Participants were able to obtain continuing education credits for their attendance.

Ms. Patterson serves as counsel with the firm in the Community Association Practice Group of Ansell Grimm & Aaron PC. Ms. Patterson represents numerous condominium, HOA and co-ops in the Hudson Valley, New York region. Ms. Patterson currently works out of the firm’s Woodland Park, NJ and White Plains, NY offices.
