AGA Attorney Richard B. Linderman responds to HOA Questions

AGA Community Association Practice Group Partner, Richard B. Linderman recently responded to a question about when boards can require a 100% member vote to amend or repeal a covenant from a Homeowner’s Association Board Member or Manager which was featured in the “National HOA Questions and Answers” Column of Pennsylvania Association Help Now Newspaper.

Mr. Linderman noted that generally, in New Jersey and Pennsylvania, the declaration of covenant require either a two-thirds or 80% vote to amend.  Mr. Linderman noted that, from an operational standpoint, a 100% vote requirement would be impractical as it would give any member absolute veto power.

Mr. Linderman has successfully represented community associations in numerous litigations, including the defense of executive boards, complex construction suits, and statutory compliance related matters. Peers recognize quality work of AGA Attorneys

Four AGA lawyers have been named to the 2016 New Jersey Super Lawyers list and two AGA lawyers have been named to the 2016 New Jersey Rising Stars List.*

The AGA 2016 Super Lawyers are:

  • Mark M. Wiechnik, a partner with the firm and a member of AGA’s Community Association Practice Group, has previously been named a New Jersey Rising Star in Construction Litigation and this year has been named a Super Lawyer in the same practice area.

The AGA 2016 Rising Stars are:

  • Jay B. Feldman, an associate with the firm and a member of AGA’s Litigation and Bankruptcy Departments, has been a Rising Star in the Bankruptcy: Business practice area for two years.
  • Richard B. Linderman, a partner with the firm and a member of AGA’s Community Association Practice Group, has been named a Rising Star for the past seven years in the Real Estate practice area.

Linderman discusses intersection of residential and commercial uses with NJ Cooperator

AGA Community Association Practice Group Partner, Richard B. Linderman recently spoke with the New Jersey Cooperator about the challenges facing mixed-use commercial and residential buildings.

Mr. Linderman noted that associations, boards and managers need to take many factors into consideration in their relationship with commercial enterprises, and that the rules for businesses can vary significantly from a residential-only site.

New Princeton Address for Ansell Grimm & Aaron, PC

On January 1, 2015 Ansell Grimm & Aaron, PC (“AGA”) expanded by opening its first office in Princeton, New Jersey in the prestigious Carnegie Center.  AGA is now making a permanent home in Carnegie Center, with its move of its Princeton office to 214 Carnegie Center, Suite 112, Princeton, New Jersey.  The new location is open for business on Monday, November 23, 2015.

The office that housed AGA since January 1st was opened for the acquisition of a group of attorneys from an International law firm who represent condominium, cooperative, and homeowners’ associations.  Prominent homeowners’ association attorneys including Elysa Bergenfeld, Richard Linderman, Mark Wiechnik, Breanne DeRaps and Stacey Patterson led by Chair, David Byrne, joined the Princeton office to kick off 2015.  Since January, AGA has grown its Princeton office to service corporate, banking and individual clients.  New practice areas include real estate, creditors’ rights, bankruptcy, copyright, trademark and general litigation with the addition of attorney Pam Mulligan.  In addition, Mercer, Burlington and Middlesex County clients benefit from AGA’s convenient Carnegie Center location as they can meet with AGA attorneys from any of our five offices in Princeton. Linderman educates CAI members on Fair Housing Act

On October 1, 2015,  Richard Linderman presented a program to several property managers and board members regarding the impact of the Fair Housing Act upon community associations.  The property managers were able to obtain educational credit through the Community Associations Institute’s Pennsylvania/Delaware Valley Chapter.  Mr. Linderman’s presentation focused on avoiding litigation and helping condominium boards deal with requests for reasonable accommodations and modifications under the Fair Housing Act.
